GENERAL CONDITIONS OF RESERVATION:

General Conditions of Reservation

These General Conditions of Reservation (hereinafter General Conditions) will regulate the commercial relationship that arises between PINEWALK SL and the user or client as a result of the contract made through the forms that PINEWALK SL makes available at its www.hotelsispins.com.

The reservation through PINEWALK SL websites will imply the express acceptance, by the client or user of the pages, of these conditions, as well as the conditions of use established for the user’s navigation through the pages owned by PINEWALK, SL.

These conditions shall apply without prejudice to the application of the relevant legal regulations applicable to each case and are subject to Force Majeure.

The General Conditions regulate the distance selling relationship between PINEWALK SL and the user or client, in accordance with the legal provisions, in particular Law 7/1998, of 13 April, on General Conditions, Law 3/2014, of 27 March, which modifies the revised text of the General Law for the Defence of Consumers and Users, Organic Law 15/1999 of 13 December regarding the Protection of Personal Data, Law 7/1996 of 15 January regarding the Regulation of Retail Trade, and Law 34/2002 of 11 July regarding Information Society Services and Electronic Commerce.

PINEWALK SL reserves the right to make the modifications it deems appropriate, without prior notice, in the General Conditions. Such modifications may be made, through its website, by any legally admissible means and shall be binding for as long as they are published on the website and until they are validly modified by subsequent ones. However, PINEWALK SL reserves the right to apply, in certain cases, Particular Conditions of Contracting in preference to these General Conditions when it considers it appropriate, which must be announced in due time and form.

By booking with PINEWALK SL through its website, the user or client expressly declares to know, understand and accept these conditions of use and the General Conditions. In the same way, the user declares to be of legal age and to have the legal capacity and to act required for access to and contracting through the PINEWALK SL websites. The user is responsible for treating confidentially and responsibly the identity and password obtained in the registration as a client, and cannot transfer them to anyone else. Once the reservation has been completed, the user will see the confirmation of his reservation on screen, and can print it as proof of the reservation made.

Confirmation of reservation and proof of reservation (impression made by the user) will not be valid as an invoice.

Booking offers and price reference In compliance with current legislation and, in particular, Law 34/2002 on information society and electronic commerce services, PINEWALK SL offers information on all possible bookings, their features and prices in the relevant section for the execution of a booking.

However, PINEWALK SL reserves the right to withdraw, replace or change the offers offered to its customers through its website, by simply changing their content. In this way, the products and/or services offered at all times by the PINEWALK SL website will be governed by the General Conditions in force in each case. FUNCTIONING OF THE ACCOMMODATION BOOKING

Indication of prices

Each possible reservation offered will have its price indicated and whether it incorporates VAT. The prices indicated on the screen will be those valid at all times, except for typographical errors. When the price is different for the aforementioned reason, PINEWALK SL will inform the client by e-mail before proceeding to collect the reservation.

Availability

The availability of the offers offered by PINEWALK SL through its website may vary depending on customer demand. Although PINEWALK SL periodically updates the database, the reservation requested by the client may be complete at that time. In such a case, PINEWALK SL will send an email to the client and inform him that the offer is not possible due to unavailability.

Methods of payment

PINEWALK SL requests in the reservations through its website the data of a credit card, reservation holder, to ensure the effectiveness of such. We remind you that the company makes a charge on your credit card when making this reservation. The company reserves the right to check the validity of the credit card before the arrival of the customer. The invoice relating to the reservation will be paid directly in the hotel, either in cash, by credit card or in any other way accepted by the hotel.

Cancellation of the reservation

The reservation deposit is subject to cancellation in the following manner:

– Cancellation up to 30 days prior to check-in: payment is refunded

– Cancellation between 15 and 29 days prior to check-in: 50% of the payment is refunded

– Cancellation between 14 and 0 days prior to check in: the payment is non-refundable

FORCE MAJEURE. No compensation will be liable to the Client if cancellations are made, by the Hotel, in connection with Force Majeure.

DATA PROTECTION

In accordance with the provisions of Organic Law 15/1999 regarding the Protection of Personal Data, PINEWALK SL informs users of its website that the personal data collected by the company through the forms on its pages, will be entered into a file under the responsibility of PINEWALK, SL, in order to facilitate, expedite and fulfil the commitments established between both parties. Likewise, PINEWALK SL informs of the option to exercise the rights of access, rectification, cancellation and opposition by letter to the address PASSEIG ANGLADA CAMARASA 77 – 07470, PORT DE POLLENÇA (ILLES BALEARS).

Unless you inform differently, we will understand that your data were not modified, and you agree to notify any changes and so on we have the agreement to answer as many queries as you deem appropriate and to send information requested.

APPLICABLE LAW AND JURISDICTION

Likewise, PINEWALK SL reserves the right to bring any civil or criminal action it deems appropriate for the improper use of its website and its contents or for non-compliance with these conditions.

The relationship between the user and the provider will be governed by the regulations in force and applicable in the Spanish territory. Should any controversy arise, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction in compliance with the relevant rules of jurisdiction and competence.
